Definitions
In these general Terms and Conditions the following terms have the following meanings:
Terms and Conditions: These general terms and conditions of Society Service.
Society Service: The private company Society Service registered in the Chamber of Commerce under number 24392623 and/or its successors in title.
Client: Legal entities as well as natural persons who wish to conclude or have concluded a booking agreement with Society Service.
Escort: The persons engaged by Society Service with a minimum age of 21 years, who carry out a Booking of the Client completely of their own free will. These persons are at all times represented by Society Service.
Assignment: Any request from a (future) Client to Society Service made via the Website, e-mail, telephone, text message or any other means of communication, in which the Client, in the opinion of Society Service, intends to use the services of Society Service.
Booking Confirmation: A confirmation from Society Service to the Client setting out the agreements between the Client and Society Service with regard to a Booking.
Booking: The agreement for assignment, provision of service, and all other agreements between the Client and Society Service.
Guaranteed Booking: A Booking that can not be cancelled free of charge.
International Booking: Any Booking that has a Traveldistance of more than 250 kilometers.
Traveldistance: The distance between Escorts' place of residence and Booking location.
Booking Rate: Rate for the company of the Escort, which includes mediationfee of Society Service.
Reservation Costs: Costs payable by Client per Booking and per Escort.
Surcharges: Rate for additional services provided by Escort or Society Service for the purpose of the Booking.
External Costs: Costs incurred by the Escort or Society Service for the purpose of the Booking with external parties.
Cancellationfee: The percentage of the Booking Rate that the Client owes in the event that the Booking is rescheduled and/or cancelled.
Opening hours: The opening hours of Society Service are daily between 10.00/10AM (ten o clock in the morning) and 22.00/10PM (ten o clock in the evening).
Website: Society Service’s website, known as www.societyservice.com.
Articles
Article 1. Applicability
1.1 These Terms and Conditions apply to all offers issued or made by Society Service as well as to all Bookings and related legal relationships. Deviations from these Terms and Conditions only apply if and insofar as they have been expressly approved in writing by Society Service.
1.2 Society Service is entitled at any time to adapt and unilaterally change the text of these Terms and Conditions. In that case, the latest text of these Terms and Conditions always applies.
1.3 The applicability of any Terms and Conditions which the Client might use is expressly excluded.
1.4 At the time of making each Booking, the Client is deemed to have agreed to the exclusive applicability of these Terms and Conditions, unless the Client and Society Service expressly agree otherwise in writing.
1.5 If one or more of the provisions in these Terms and Conditions are void or annulled, the other provisions of these Terms and Conditions remain fully applicable. Society Service and the Client will then enter into consultation in order to agree on new provisions to replace the void or voided provisions, whereby, if and as far as possible, the purpose and scope of the original provision will be taken into account.
1.6 The Client who has already made a Booking with Society Service is deemed to tacitly agree to the applicability of these Terms and Conditions to subsequent and/or additional Bookings from and/or services to the Client in question.
Article 2. Registration, contact and legality
2.1 Society Service is a legal, licensed and registered escort service, registered with the Rotterdam Chamber of Commerce under number 24392623 and in possession of permit es.F.0036181.2020 from the municipality of Rotterdam.
2.2 All services of Society Service are subject to 21% VAT, under VAT number NL.819156073B01.
2.3 Society Service is located at Elektroweg 11L, Rotterdam. Visits to this address are not possible without prior appointment.
2.4 Written correspondence can be sent to: Postbus 19275, 3001BG Rotterdam. The response period is at least 14 days.
2.5 Society Service can be reached by e-mail at office@societyservice.com. During opening hours, the response period is a maximum of 6 hours.
2.6 During opening hours, Society Service can usually be reached by phone at +31882228900 or +31622288001. SMS and WhatsApp messages will be answered within 3 hours. Voicemail messages will only be answered if a callback has been requested and a name and telephone number have been left. Missed calls will be called back within 30 minutes, if possible.
Article 3. Coming into effect of the Booking
3.1 All quotes and/or offers made by Society Service are without obligation, unless otherwise stated. No rights can be derived from the availability in the Escort profile.
3.2 A Booking will only come into effect when Society Service has expressly accepted the Assignment. The Booking Confirmation is considered a correct representation of the Booking, except for obvious spelling and typing errors.
3.3 The Booking replaces all previous proposals, correspondence, and agreements, both written and verbal.
3.4 The Client has no legal right to terminate the distance contract, as it concerns an agreement for services relating to leisure activities that take place at a specific time or in a specific period.
3.5 Society Service has the right to refuse an Assignment at any time, without stating reasons.
3.6 Society Service may refuse a Client, without obligation to provide an explanation. If the refusal is permanent, the Client will be notified and summoned not to contact Society Service again. In the event of non-compliance, Article 16 applies and the Client will forfeit an immediately due fine from Category A.
Article 4. Rates
4.1 Unless otherwise stated, all rates on the Website are in euros and include 21% VAT. Amounts, including travelexpenses, are rounded up to the nearest €25.
4.2 The Client owes Reservation Costs of €50 per Booking and per Escort. These will be waived if the Client does not reschedule or cancel the Booking and meets the requirements as set out in these terms and conditions.
4.3 The profile of each Escort contains an overview of the rates per maximum duration. The following applies:
- Unless otherwise agreed, the Standard Rates apply.
- The duration agreed before the Booking starts is the "pre-booked booking duration". Within the first half of that duration, and only between 08.00 (AM) and 24.00 (midnight), the Booking can be extended to a desired duration within the same rate category (Standard or Dinner Date & Overnight), provided that the stated conditions are still met. Only the extra amount for the longer duration is charged.
- Extensions requested after the first half of the pre-booked booking duration and/or between 24.00 (midnight) and 08.00 (AM) are charged at the hourly rate for extension (Extension Rate), as shown in the Escort profile.
- If the pre-agreed booking duration is exceeded by more than 15 minutes, this extension is always subject to the Extension Rate, unless the Client informs the Escort that the pre-agreed booking duration was being or was about to be exceeded and the Client does not wish to extend the booking.
4.4 To qualify for the Dinner Date & Overnight Rates, the following criteria must be met:
- The Dinner Date or Overnight Stay is decided before the start of the Booking and has a Traveldistance of a maximum of 250 kilometers.
- In the case of a Dinner Date, Client spends at least the first half of the booking in public with the Escort and travels together to and from the restaurant (and excursion).
- In the case of a culinary Dinner Date, at least the first half of the booking will be spent on an extensive dinner of at least 3 courses. The duration of this Dinner Date is 5 to 8 hours and the booking can commence between 17.30 (5.30PM) and 20.00 (8 PM).
- In the case of a cultural Dinner Date, at least the first half of the booking will be spent on a dinner of at least 2 courses and a cultural excursion such as theater, concert or performance. The duration of this Dinner Date is 8 or 10 hours and the booking can commence between 16.30 (4.30PM) and 19.00 (7 PM).
- In the case of an Overnight, the booking duration may be between 12 and 18 hours. The Overnight may start between 16.00 (4PM) and 22.00 (10PM). For Overnights starting at 20.00 (8PM) or earlier, the booking starts with a dinner. Client and Escort spend the night together, where the Escort can sleep undisturbed for at least 6 hours. The Overnight ends with breakfast or brunch, between 7.00 (7AM) and 12.00 (noon).
4.5 The Companionship Only Rate requires a minimum of three hours. No erotic activity or physical contact takes place, the Escort remains fully dressed and, if there is an overnight stay, sleeps in a separate bedroom.
4.6 If the conditions of the relevant rate category are not (or no longer) met, the rate of the entire booking will be recalculated at the Standard Rates.
4.7 Society Service may incur External Costs for the purpose of the Bookings and client verification. The cost price is increased by 21% VAT, is fully borne by the Client and must be paid in full in advance. There is no right to a refund, for example in the event of cancellation or change of the Booking or Assignment.
4.8 Travelexpenses are included up to a Traveldistance of 25 kilometers. For longer distances, a surcharge of €1 per kilometer applies. The Escort's profile will state the nearest major city for discretion. Travelexpenses are calculated via the calculator in the rate section of the profile based on the exact location of the Escort. The calculator uses the best route by car at that given moment which may slightly vary over time. For Bookings with a Traveldistance of more than 250 kilometers, the travelexpenses are determined per Booking and are available upon request. The following Surcharges also apply to travelexpenses:
- If the Booking ends at a different location than where it started and/or Client changes the location of a Booking, a surcharge may apply.
- If the Escort usually travels by car, a Surcharge for additional work applies for Bookings of 5 hours or less, where the outward journey takes place during rush hour (working days from 07:00 - 08:30 and 16:30 - 18:30).
- If the Escort usually travels by Public Transport and, after the Booking, cannot return without the total travel time including waiting time at least doubling compared to the outbound journey, additional External Costs for the Escort’s return journey will be charged to the Client.
4.9 In addition to travelexpenses, other Surcharges may apply, which can be divided into:
- For avoiding cancellation terms: €100 per occurrence when the Client extends the Booking and Booking thereby becomes a Guaranteed Booking or when the duration of a Guaranteed Booking is extended within its first half by more than 25%.
- Additional work by Society Service: €50 per (part of an) hour for additional work by Society Service (such as Concierge Service). The rate is doubled if additional work is required outside our Opening Hours or with rush (less than 6 hours notice).
- Additional work by Escort before and/or after the Booking: €50 per (part of an) hour.
- Additional work by Escort during the Booking: Varying per extra service. Client can consult these Surcharges with the desired additional (erotic) services.
- Escort compensation for Client-induced changes: repayment of directly attributable costs plus 21% VAT and up to €200 per (part of a) working day of lost income if the Client extends the Booking and/or asks the Escort to make herself available at a time not shown as available.
4.10 If the Client believes that paid Additional Work was not provided, the Client must email Society Service within 24 hours after the Booking ends and give a brief explanation. After verification, the relevant part of the surcharge is credited to the Client's account. After the 24-hour period the surcharge is final.
4.11 No rights can be derived from discounts and are only applicable if they have been agreed in advance and confirmed in the Booking Confirmation.
Article 5. Payments
5.1 All payments must be made prior to the Booking or at the latest immediately at the commencement of the Booking. If the Client is granted a deferral of payment in the event of an extension of the Booking, the outstanding amount must be paid in cash in the last fifteen minutes of the Booking or immediately after the Booking via bank transfer.
5.2 Prior to the Booking, the Client will inform which payment method the Client wishes to use.
5.3 The availability of all payment methods listed is not guaranteed and is subject to availability. Society Service may, without giving any reason, impose restrictions on the Client or Booking regarding the available payment methods and/or require a deposit.
5.4 In order to ensure discretion, a general consultancy name is used for electronic payments. This name is registered as the trade name of Society Service.
5.5 Society Service accepts payments via bank transfer and bank payment request. Banktransfer is the standard payment method. Bank payment requests are offered on request only in case of extending the Booking. Bank costs are borne by the Client. Bank payments can not be made by Clients based in Cuba, Iran, North Korea, Sudan, Syria, Crimea region in Ukraine.
5.6 Society Service accepts cash payments in euros at the commencement of the Booking. Denominations of €200 and €500 are not accepted. If the Client can only make payments in denominations of €200 and €500, an administrative surcharge of 10% applies, with a minimum of €100. The Escort does not carry change and all denominations must be in mint condition.
5.7 Society Service accepts cash payments in US dollars or British pounds at the commencement of the Booking. The exchange rate applicable on the day of Booking is assumed, plus additional bank and exchange costs and a 5% service surcharge. The value of the foreign currency that Client wishes to use may not be less than €100 and not more than €500 (new Client) or €2000 (repeat Client). The Escort does not carry change and all denominations must be in mint condition.
5.8 Society Service accepts payments by credit card and debit card (Maestro, V-Pay, Mastercard or Visa) for a surcharge of 5% of the total amount, provided this has been approved in advance. Card payments are only accepted under the following conditions:
- Booking takes place in the Netherlands.
- Client accepts that the processing of card payments takes an average of 10 minutes, which is part of the booking duration, and acknowledges the surcharge as compensation for the costs of offering card payments, such as the use of a mobile payment terminal during the Booking.
- The card must be present at the Booking, registered in the name of the Client and provided with a signature. The Client must show valid identification, not be under the influence of large quantities of alcohol and/or drugs, and, if requested, complete an additional authorization form.
- If the payment is not successful due to the Client's actions (e.g. insufficient balance or failed authorization), the payment must be made by alternative means, whereby costs and time are for the account of the Client. Should the payment fail due to restrictions of the card issuer, the Client is responsible for an alternative payment method.
- If the payment fails due to a technical malfunction of the payment terminal or application, the Client is responsible for an alternative payment, but the extra costs and time are not at the expense of the Client.
5.9 There is no right to a refund of any amount paid for work already performed or costs in favor of a Sneak Preview, Surcharge, Guaranteed Booking or External Costs, unless there is intent or deliberate recklessness on the part of Society Service and/or the Escort.
5.10 If there is (part of) an amount paid by the Client for a Booking that is not a Guaranteed Booking and that has not yet taken place or has not been used in any other way, for example because the Client has cancelled the Booking, this amount, after deduction of any costs or outstanding amounts, as a standard will be added to the Client's credit for future Bookings. This credit expires after 3 years, unless an extension has been agreed before the expiry of this term.
5.11 Instead of adding to the credit as described in the previous article, Client may request that this amount be returned to Client's bank account. This request may be submitted by Client up to 48 hours after it became known that there is any credit. If the amount relates to a Booking for which Client does not owe a Cancellationfee, a Surcharge for additional work of €50 will be charged. If the amount relates to a Booking for which Client does owe a Cancellationfee, the offer to halve this Cancellationfee, as set out in article 12.8, will lapse. An exception to this applies when the Booking has been cancelled by Society Service or the Escort, for a reason other than a breach of these Terms and Conditions by Client. In that case, the amount will be returned to Client without the Surcharge for additional work being charged.
5.12 The services provided by Society Service are personal in nature and are therefore not tax deductible for the Client if he/she uses the services of Society Service himself. To prevent fraud and protect the Client's privacy, no invoice is issued to private individuals. An invoice will only be issued when a company purchases services from Society Service and these are also delivered to this company. This is done within 14 days after execution of the Booking via e-mail in PDF format. The content of the invoice is always truthful and in accordance with laws and regulations.
5.13 To prevent trade-based money laundering (TBML) and other possible criminal activities, Society Service is obliged to investigate the origin of bank payments if they come from a bank account with a name other than the Client. Society Service may ask the Client to provide documents showing that the Client is authorised to make the transaction and is the ultimate beneficial owner (UBO) of the account. The payment will only be considered valid after receipt and approval of the requested documents.
5.14 In the event of bankruptcy, suspension of payments, administration, guardianship or a comparable statutory measure on the part of Society Service, advance payments made by the Client for Bookings not yet performed and any credit registered in the Client’s name will be treated as immediately due and payable claims of the Client against Society Service. Ongoing Bookings may in that case be cancelled. Set off of mutual claims is permitted to the extent allowed by law and settlement will take place in accordance with insolvency law.
5.15 All amounts owed by the Client to Society Service become immediately due and payable if a payment term is exceeded or if bankruptcy or suspension of payments has been applied for or declared with respect to the Client, an attachment has been levied, admission to the statutory debt rescheduling scheme for natural persons has been requested, the Client has been placed under guardianship, has died, or otherwise lost free control over their assets. If payment is not made, the Client will be in default by operation of law and article 5.16 applies accordingly.
5.16 If the stated payment terms are exceeded, the Client will be in default by operation of law without any further demand or notice of default being required. From that moment the Client owes default interest of 3 percent per month or part of a month on the outstanding amount. If Society Service outsources its claim for collection, the Client also owes all reasonable extrajudicial and judicial collection costs. This provision also applies to amounts that have become immediately due and payable under article 5.15.
5.17 If Society Service is successful in legal proceedings, all costs incurred by Society Service in connection with those proceedings are for the account of the Client.
5.18 In all cases Society Service, in addition to the rights set out in this article, is also entitled to claim performance and or damages.
Article 6. Confidentiality, privacy and security
6.1 The nature of the services is personal and private and must be treated with the utmost confidentiality by all parties involved.
6.2 The Client will observe absolute confidentiality with regard to the Society Service company and/or the Escorts working there. The Client will not directly or indirectly publish, release or otherwise make accessible to third parties any information relating to the services and the business of Society Service and the Escorts working there, regardless of whether this information is confidential or secret, without explicit permission from Society Service. The Client will observe absolute confidentiality with regard to persons or institutions that do or have done business with Society Service. The Client will not engage in this behavior via third parties in any way whatsoever. In the event of a violation of this Article by the Client, Article 16 of these Terms and Conditions applies and the Client forfeits an immediately payable fine from Category B.
6.3 All information of the Client that Society Service has access to by virtue of its services shall be treated confidentially and shall only be used in accordance with the Privacy Policy of Society Service. Escort is also bound by an agreement with Society Service to maintain the confidentiality of all information about the Client and Booking.
6.4 In the event of a gross violation of these Terms and Conditions, Society Service reserves the right to share the anonymized data of the Client within the Association of Dutch Escort Companies (Vereniging van Nederlandse Escortbedrijven), to prevent the Client from causing further damage to them.
6.5 Society Service is committed to protecting the Client's personal data, within reason but in several ways and with the expertise of external parties. Unless there is intent or deliberate recklessness on the part of Society Service, Society Service cannot be held liable in any way for the disclosure of this information.
6.6 This Website uses a secure (SSL) connection to send forms and uses cookies to offer visitors to the Website an optimal service. Cookies are anonymized and you can set your browser to manage their use. The Website may contain links to other websites. Society Service is not responsible for the content or material of these websites and does not endorse them, either tacitly or explicitly. Any questions or comments regarding these other websites should be directed to the operator or operators of these websites.
Article 7. Booking requirements
7.1 An Assignment can be provided daily during Opening hours. Client will (also) notify Society Service by telephone of Assignments that commence within 6 hours.
7.2 A Booking can commence between 08.00 in the morning and 23.00 (11PM). The time zone of booking location applies to this.
7.3 A Booking with a duration of less than 2 hours is not possible. Minimum booking duration may differ per Escort and per booking location. This is determined as follows:
- The general minimum booking duration can be found in the Escort profile in the rates section.
- This minimum booking duration may be increased based on Traveldistance required for a Booking. The calculator in the rate section of the profile can be used to calculate the minimum booking duration for Booking with a Traveldistance of up to 250 kilometers. The minimum booking for destinations further away is always on request.
- An additional hour must be added to the minimum booking duration at the booking location if the Booking starts outside Opening hours.
If Client wishes to spend less time with Escort, the rate for this minimum booking duration still applies. Additional costs may also be charged to the Client for External Costs relating to transport, food, drinks, internet access and accommodation for Escort during the waiting time between the early end of the Booking and the required minimum booking duration.
7.4 Bookings may take place only in a clean and orderly private living space or hotel/accommodation with a rating of at least four stars. The accommodation may not be shared with others and must include a bedroom and a seating area suitable for at least the minimum number of persons present, namely the Client or Clients and the Escort or Escorts, as well as a bathroom and toilet. It is the Client’s responsibility to ensure that the accommodation permits the number of persons present. If a hotel room does not offer sufficient seating, the hotel bar or lounge may serve as an alternative. Bookings are never possible in poorly maintained locations, unsafe neighbourhoods, cars, rendezvous hotels, sex clubs, student housing, hostels, shelters, adult cinemas, or locations with similar characteristics.
7.5 During bookings, no persons other than the Client are present at the booking location, unless otherwise agreed or in the case of a public occasion.
7.6 Travel during the Booking can be on foot for distances shorter than 1 kilometer, provided that the weather conditions and safety allow this. A car must be used for longer distances. Public transport is not permitted, unless previously agreed.
Article 8. Client requirements
8.1 Client is at all times obliged to provide accurate and complete information regarding their identity, contact details, and the Booking.
8.2 New Clients are required to cooperate with a verification procedure, which may include, but is not limited to, a deposit via bank transfer, ID verification, proof of the booking location, and/or the timely submission and verification of the room number.
8.3 Client is responsible for all communication regarding the Booking. It is only permitted to place a Booking on behalf of a third party if the Client is unable to do so due to a physical limitation or when this has been explicitly approved by Society Service.
8.4 Client must be at least 21 years old or turn 21 in the relevant calendar year. If there is any doubt about the Client's age, Society Service or the Escort may at any time require the presentation of a valid form of identification.
8.5 Client may not be under the influence of, nor in possession of, excessive amounts of alcohol and/or (soft) drugs during the Booking. The Client may never encourage or force the Escort to consume alcohol or (soft) drugs.
8.6 Client must treat the Escort with respect and may never force or encourage her to perform actions that go against her wishes, comfort, or the law. The Escort acts at her own discretion and of her own free will.
8.7 Client is prohibited from requesting, offering or exchanging the Escort’s contact details outside the mediation of Society Service. Contact details include, among other things, phone number, email, social media, chat and calling apps, QR codes and similar identifiers. In case of a request or suspicion, a single warning will be issued. On repetition the Client forfeits a Category A penalty as referred to in article 16. If the Client wishes to have contact with the Escort outside mediation, the Client must notify Society Service in advance and article 14 applies.
8.8 The Client is obliged to report any medical complaints or conditions that may affect the health of the Escort or the execution of the Booking at the time of placing an Assignment. Any medical conditions requiring potential medical intervention during the Booking must also be reported in advance.
8.9 The Client must never request or encourage unsafe sexual practices, including but not limited to unprotected oral, vaginal, and/or anal sex, ejaculating in the mouth or on the face, or genital contact without protection.
8.10 The Client has the following obligations of best efforts:
- Ensure a high level of personal hygiene, with particular attention to oral and intimate hygiene.
- Get to know the Escort on a mental level and possess sufficient language skills to have meaningful interactions, where social, emotional, and intellectual aspects receive at least as much attention as the physical and erotic interaction.
- Engage in activities and excursions outside the hotel or residence during the Booking, which is also mandatory for Bookings of 6 hours or longer.
- Ensure that the Escort can regularly eat and drink during the Booking, with a minimum of one drink every 2 hours and one meal every 6 hours and/or during usual dining times.
- Refrain from initiating any sexual activities during the first hour of the Booking; this is reserved for the Escort.
- Provide the Escort with an uninterrupted opportunity to sleep, with a minimum of 4 hours during Standard Bookings of 12 to 24 hours during usual sleeping times, 6 hours during Overnight Bookings, and 8 hours during Bookings longer than 24 hours.
- For Bookings longer than 24 hours, give the Escort at least 2 hours of private time each day.
- Ensure that the Escort remains accessible to Society Service and for emergencies, and has regular access to the internet.
8.11 Client respects the Escort's privacy at all times and will adhere to the following guidelines, among others:
- All information provided by the Escort is treated as confidential.
- No photo, audio, or video recordings of the Escort may be made, nor may the Escort make any of the Client.
- Client must not ask for or attempt to discover the Escort's real name.
- Client must never inspect the Escort's personal belongings, such as her bag or mobile phone.
- Permission must be obtained from both Society Service and the Escort before taking the Escort to non-public social events.
- The Escort's privacy must be respected during bathroom visits, personal phone calls, and when she needs to show identification.
- No (public) reviews may be posted without the explicit consent of Society Service. This consent is never granted if the review could harm the Escort’s privacy or is graphic in nature.
8.12 Client will at all times refrain from (any attempt to) discuss or negotiate these Terms and Conditions, including the rate of the Booking, during the Booking.
8.13 Client will at all times refrain from (any attempt at) any act or omission that endangers the safety or image of Society Service and/or the safety or image of Escort and/or reveals the identity of Escort.
8.14 The Client will at all times refrain from (any attempt to) unlawful acts against Society Service and/or Escort, including but not limited to deception, fraud, intimidation, threats and computer intrusion. In the event of a violation of this article, Article 16 of these Terms and Conditions applies and the Client forfeits an immediately payable fine from Category C.
Article 9. International Bookings
9.1 An International Booking cannot take place in countries where a negative travel advice applies, with a predominant religion or major inequality between men and women.
9.2 The Standard Rates always apply to International Bookings and an International Booking is always a Guaranteed Booking, which cannot be canceled free of charge.
9.3 An International Booking always involves External Costs, which are fully at the Client's expense and for which refunds are not possible. External Costs mainly consist of travelexpenses, visas, accommodation and meals and drinks during the trip from Escort to Booking.
9.4 A Surcharge for additional work applies. The first hour of work performed by Society Service will be waived, provided that the Client does not cancel or change the Booking (request).
9.5 The minimum booking duration for international destinations is always in consultation. In most European cities there is a minimum booking of 12 to 16 hours. In other cities worldwide, a minimum of 24 to 48 hours applies. The start time and end time of the International Booking are tailored to the travel options. This may require a higher minimum booking duration.
9.6 An International Booking requires a deposit via bank of at least 50% of the Booking Rate and 100% of the External Costs. The remaining payment during the Booking may never exceed €5.000.
9.7 Availability for International Booking varies per Escort and is indicated in the Escort's profile.
9.8 If Escort is available for an International Booking Assignment, Society Service will send the Client a proposal for the travel methods. The most comfortable travel option with the fewest transfers and shortest total travel time will be chosen. Flights take place in economy class and travel by train in first (premium) class. A seat with extra legroom and/or in economy comfort class is required for overnight flights and flights with a duration of 8 hours or more. Unless otherwise agreed, the cheapest ticket will be chosen, regardless of the options for cancellation/change. Unless absolutely necessary to reach the destination of the Booking, the Escort's journey to the Booking cannot commence before 6.00/6AM.
9.9 If the Client agrees with the proposal for travel methods, Society Service will send the Client a price indication consisting of the Booking Rate and estimated External Costs. If this is agreed upon, the Client will pay a deposit and the Booking will be considered confirmed. The journey to the International Booking can be commenced by Escort at the earliest 24 hours after receipt of the Client's deposit to Society Service.
9.10 After receipt of the Client's deposit, Society Service will check the price of External Costs. If there is a price difference of up to 10%, Society Service will immediately book External Costs. If the price difference is higher than 10%, Society Service will first consult with the Client. After booking the External Costs, the Client will be informed of this.
9.11 All costs associated with changing and/or canceling External Costs will be borne by the Client, unless there is intent or deliberate recklessness on the part of Society Service and/or Escort.
9.12 After the Escort returns to the Netherlands, a final quotation will be provided to the Client if this differs by more than €50 from the original proposal. Any overpayments will be added to Client's credit. Any outstanding amounts will be paid by the Client within 5 days via bank transfer.
9.13 If Society Service foresees problems at any time and reasonably during the Escort's journey to the International Booking, the Client will be immediately informed of this.
9.14 If the door-to-door travel time exceeds 12 hours, Escort will sleep the first night in a private bedroom. This night is part of the booking duration.
9.15 If Escort is delayed during the journey to the International Booking, and this delay is not caused by the fault or actions of Escort or Society Service, this delay will be part of the booking duration. Delays incurred during the return journey are not part of the booking duration, unless this delay is caused by the Client's fault or actions.
Article 10. Guarantees
10.1 Society Service guarantees that the Escort’s profile on the Website presents the Escort in a realistic manner. The Client may cancel the Booking free of charge within 10 minutes of the start if, in the Client’s reasonable judgment, the Escort does not in reality correspond to the presentation on the Website, in appearance and personality alike. This right applies only if the Client has not met the Escort before and has made a reasonable effort in advance to assess suitability, for example by reading the profile and, if available, viewing the face photos in the member account. The Client must notify Society Service of the cancellation immediately.
10.2 Client may cancel the Booking within 20 minutes of the start if, in the Client’s judgment, there is no click or chemistry with the Escort, provided the Escort was booked on the advice of Society Service, for example through bespoke or personal matchmaking. In that case the cancellation costs equal the full travelexpenses plus €250. The Client must notify Society Service of the cancellation immediately.
10.3 The rights set out in 10.1 and 10.2 apply only if:
- Escort has not been touched, undressed, or subject to any attempt to do so.
- There is no sudden unavailability or schedule change on the Client's side preventing continuation of the Booking.
- Booking is not a Guaranteed Booking and the travel time one way is maximum of 1 hour.
- Client and Booking otherwise comply with these Terms and Conditions.
10.4 Society Service provides no guarantees to the Client regarding the Client's experience during the Booking, given the personal nature of the service. However, both Society Service and the Escort have an obligation to make reasonable efforts toward the Client. Although the content and execution of the Booking are largely determined by the Escort, in accordance with the Consent Policy of Society Service, the Client may expect the following professional efforts from the Escort:
- The Escort strives to be present on time and will inform the Client directly via Society Service in the event of any delay.
- The Escort ensures high personal hygiene and a well-groomed, professional presentation, taking into account the Client's personal preferences.
- The Escort pays sincere attention to the Client and does her best to make the experience pleasant and memorable for both parties, with respect for the personal wishes and boundaries of the Client and herself.
- Escort will make an effort to build a personal bond with Client on a social, intellectual and emotional level, with the intention of naturally expanding this to erotic and intimate contact.
- Escort will behave discreetly at all times, according to appropriate manners and etiquette, and will respect the privacy of the Client, both during and after the booking.
- Escort will treat Client with respect during the Booking, behave with integrity and refrain from inappropriate practices.
10.5 If, in the opinion of the Client, the Escort does not adhere to the efforts described in Article 10.4, the Client must promptly report this to Society Service. In such cases, Society Service will contact the Escort and provide the opportunity to make adjustments during the Booking within a reasonable timeframe. The time spent on this will not be borne by the Client. If the Escort is unable or unwilling to make adjustments, the Client has the right to terminate the Booking early, with the unspent booking duration being credited to the Client. A condition for this is that the Booking is not a Guaranteed Booking and that both the Client and the Booking meet all the requirements as stipulated in these Terms and Conditions.
Article 11. Change, rescheduling or cancellation by Society Service
11.1 In the event of a change or cancellation of the Booking by Society Service, the Client will be contacted as soon as possible. For reasons of discretion, this is done via email. The email will only be followed up by telephone if necessary.
11.2 Society Service is at all times permitted to cancel, change and/or terminate a Booking early if:
- The booking location is not available.
- In the opinion of Society Service the privacy, integrity and or safety of the Escort cannot be guaranteed during the Booking or during travel to the booking location
- Escort indicates that he/she is physically or mentally unable to perform the Booking, or that performing the Booking would conflict with his/her will, wishes or comfort
- There is a default on the part of the Client, because the Client does not meet the agreed conditions of the Booking within the applicable deadlines, or there are reasonable grounds to believe that the Client will not do so; in that case article 11.3 applies.
- Circumstances arise that mean it cannot reasonably be expected of Society Service to fulfil its obligations under the Booking.
11.3 In the event of default by the Client, Society Service will give the Client a single opportunity to remedy the default within a reasonable period. The time and work involved are at the Client’s expense and, if the Booking has already started, any waiting time counts as part of the booking duration. If the default is not remedied or the Client is not willing to do so, Society Service is entitled to cancel the Booking or terminate it immediately, without any right to a refund of the Booking Rate. External Costs, travel expenses and Surcharges will be charged in full. All reasonable additional costs that directly result from the early termination will also be charged to the Client. In these situations the Client cannot rely on the cancellation terms in article 12 or the guarantees in article 10.
11.4 Society Service can adjust the start time of the booking with a maximum difference of two hours (earlier or later), for example in the event that the arrival of the Escort is delayed. The following applies to this;
- If the arrival of the Escort is delayed by 60 minutes or less, the Client has no right to cancel the Booking and the minimum booking duration remains unchanged. Any delay by the Escort will not be deducted from the booking duration.
- If the arrival of the Escort is delayed by 60 minutes or more, the Client has the right to cancel the Booking or shorten the booking duration so that the original end time is maintained provided that; The Traveldistance is less than 250 km and; The Booking was made no less than 5 hours ago and; The Client has not agreed to a new start time for the Booking.
- In the event of a delay of 15 minutes or more, Escort will compensate the Client for the inconvenience caused by the delay by extending the booking by 15 minutes free of charge, provided that the availability of Escort and possibilities for Escort to travel back allow this in the opinion of Escort.
11.5 If the Booking can only take place under changed circumstances, the Client is allowed to cancel the Booking free of charge, unless there is a situation as set out in Article 11.4.
11.6 When placing the Booking, the Client must notify Society Service in advance and in writing of any costs that are specific to the Booking and non refundable. If Society Service reschedules or cancels the Booking while the Client has complied with these Terms and Conditions and the Client does not accept a reasonable alternative offered by Society Service, Society Service will reimburse the previously notified non refundable costs up to a maximum of €500 per Booking. This arrangement does not apply in cases of force majeure as referred to in article 17. Society Service and the Escort are not liable for any further direct or indirect loss or expenses of the Client.
11.7 In the event that the Booking has already commenced and Escort wishes to terminate the Booking prematurely, for reasons other than a breach of these Terms and Conditions by the Client, for example due to illness or calamities in the private sphere, only the time that the Client has already spent with the Escort will be charged to the Client.
Article 12. Change, rescheduling or cancellation by the Client
12.1 In the event of a change, rescheduling, or cancellation of the Booking by the Client, the Client must inform Society Service as soon as possible by email. If less than 6 hours' notice is given, the Client must follow up by telephone. The change, reschedule, or cancellation is only valid after receipt has been confirmed by Society Service.
12.2 If the Booking is made with multiple Escorts, each Escort is considered a separate Booking.
12.3 Booking is a Guaranteed Booking if one or more of the following criteria are met:
- The Traveldistance is more than 250 km.
- The booking duration is 24 hours or more.
- New Client has cancelled or rescheduled the first booking.
- Client has cancelled at least two of the six most recent and/or scheduled bookings.
- This is required for the Client or Escort for another reason, or has been specifically requested by the Client.
If, due to changed circumstances, the conditions for a Guaranteed Booking as described above are met, this classification will also apply to all future, already scheduled bookings. These bookings will then be considered Guaranteed Bookings and will be subject to the corresponding terms and Cancellationfees.
12.4 We distinguish the following Clients, whereby only a Booking that was not cancelled counts:
- New Client: First Booking with Society Service in the past 3 years.
- Non-Member: Client booked with Society Service in the past 3 years, but not in the past year.
- Member: Client booked with Society Service in the past 3 years, including in the past year and has an active member account.
- Premium Member: Client booked at least 10 times with Society Service in the past 3 years, including in the past year and has an active member account.
12.5 A change occurs if the Client wants to adjust the start time of the Booking by two hours or less (earlier or later). If agreed by all parties, this can be done free of charge up to one hour before the Escort starts the journey to the Booking. After that, any waiting time of the Escort is part of the booking duration.
12.6 A rescheduling occurs if the Client wishes to change the starting date and/or time of the Booking by more than two hours (earlier or later) to a new date and/or time within 1 month (earlier or later) with the same escort(s), whereby the booking duration remains the same or longer and other booking specifications do not differ substantially. A rescheduling of a Booking is possible once up to 2 weeks (14 days) before the start of the Booking at the following Cancellationfees:
- Booking (not guaranteed): None
- Guaranteed Booking: 25%, with a minimum of €250
12.7 A cancellation occurs if the Client wishes to change the Booking in a manner other than as set out in Articles 12.5 and 12.6. This is possible at the following Cancellationfees:
- Booking (not guaranteed): None, provided that the cancellation is communicated before the start of the Booking with at least the following notice: 3 days (72 hours) for a New Client, 2 days (48 hours) for (Non-)Member and 1 day (24 hours) for Premium Member. After that, the Cancellationfee is 25% with a minimum of €250. If cancellation is only confirmed after Escort has started preparations for the booking, or in the case of a no-show, the Cancellationfee is 100%. Preparation takes at least two hours, with extra time for special requests, plus travel time.
- Guaranteed Booking: Up to 3 days (72 hours) before the start of the Booking 50%, after that 100%.
12.8 The cancellationfee is halved if this can be paid from the deposit and/or credit of the Client and/or if the Client pays this to Society Service within 14 days via bank transfer. After 14 days, the payment term expires.
12.9 Our cancellation policy is designed to accommodate unforeseen circumstances with a valid reason. Requests for the substitution of an escort are not acceptable and will incur an additional charge of €250 per escort.
12.10 If the Client wishes to prematurely terminate a Booking that has already started, the Client will be charged the entire Booking Rate. Only if the early termination is the result of illness or calamities in the private sphere of the Client and the Booking does not concern a Guaranteed Booking, the Client will be charged for the time already spent with Escort, rounded up to whole hours and with a minimum of the minimum booking duration of Escort at the relevant booking location. In addition, the Client will be charged for additional costs incurred due to this premature termination.
Article 13. Member access and credit
13.1 If a Booking has been made in the past year, the Client can request a member account on the Website. This request can always be refused by Society Service without stating a reason.
13.2 Login credentials and the member account will be refused and/or immediately terminated if;
- Client exchanges contact details with Escort in any way, has contact with Escort outside the mediation by Society Service or makes any attempt to do so.
- Client asks about unsafe (oral) sex during Booking.
- Escort did not experience the Booking with Client as pleasant.
- The Client provides login details or content of the member area to third parties and/or reproduces, copies or otherwise multiplies content of the member area.
- Client has not otherwise complied with these Terms and Conditions.
13.3 If the Client provides his login details or content of the member section to third parties and/or reproduces, copies or otherwise multiplies content of the member section, Article 16 of these Terms and Conditions applies and the Client will forfeit an immediately payable fine from Category B.
13.4 Until April 2023, loyalty points could be earned. The loyalty points programme has ended. All loyalty points have expired. Any credit that derives in whole or in part from converted loyalty points has also expired and cannot be used. Society Service updates credit manually. The adjustment of this portion of the credit may not yet have been processed; this credit may not be used.
13.5 Client can obtain extra credit by carrying out work for Society Service, as stated on the Website. An active member account is not required for this. This is in no way an invitation and/or confirmation of orders to invade our systems and/or breach security (hacking). We will take legal action against any attempt to do so. In this case, Article 16 of these Terms and Conditions applies and the Client forfeits an immediately payable fine from Category C.
13.6 Client can add extra credit by making a payment to Society Service that is higher than the rate for the next Booking. The additional amount paid will be added to the Client's credit and will be visible as a credit in the member profile within 10 days after the next Booking. The most recent change to the credit is also visible here. If the Client does not have a member account, the Client can always request the amount of the credit and the most recent change via e-mail from Society Service, to which a response period of 48 hours applies. The credit has the same validity as set out in Article 5.10 of these Terms and Conditions.
13.7 The Client can at any time request to delete his personal data and/or terminate the member account, whereby all credit and login options are lost. If a member account is terminated or deactivated by the Client for any other reason, this credit will not be lost unless the validity period has expired.
13.8 Client can request a Sneak Preview. If Sneak Preview is approved, the Client owes a payment of €250. This amount will only be deducted from the Booking Rate of the Client's next Booking if the Sneak Preview is completed within one month after payment and within one week after access results in a new confirmed booking which the Client no longer cancels or changes.
Article 14. Matchmaking
14.1 Society Service offers various matchmaking tools on the Website. The aim of the matchmaking tools is to find the perfect Escort for the Client to make the Booking as successful as possible. The matchmaking therefore serves a business purpose in favor of the services provided by Society Service.
14.2 If the Client and Escort experience the Booking as so enjoyable that they both wish to investigate the possibilities for a purpose other than that described in Article 14.1, the procedure as set out in Article 14.3 applies. With other purposes, for example, but not exclusively, reference is made to a romantic relationship, friendship or business relationship not for the benefit of Society Service.
14.3 The procedure is as follows:
- Client and Escort communicate this wish separately and immediately to Society Service by email. Society Service will provide feedback within 48 hours as to whether an exploration period can be initiated.
- Client and Escort spend an exploration period together during Bookings with a total duration of at least 500 hours or at an aggregate Booking Rate of €25.000 or more.
- If Escort and Client decide to continue contact with each other after the exploration period, Client owes Society Service a mediation fee of €10.000 via bank transfer.
14.4 If the Client does not follow the procedure set out in Article 14.3 and/or maintains contact and/or spends time with Escort without mediation by or permission from Society Service, Article 16 of these Terms and Conditions applies and the Client forfeits an immediately payable fine from Category C.
Article 15. Copyright, trademark and other intellectual property protection
15.1 The names Society Service, Interact Service, Ontknaapservice and Virgin Experience, the logos, the images, and all other Society Service-related marks depicted on this Website, whether registered or unregistered, are trademarks or service marks of Society Service.
15.2 Except when otherwise indicated, all materials on this Website, including, but not limited to, photographs, logos, other images, illustrations, text, video clips, audio clips and written and other materials contained on this Website are protected by copyright, trademarks and/or other intellectual property rights owned, or used with permission of their owners, by Society Service.
15.3 This Website as a whole is protected by copyright and other intellectual property rights. All rights are reserved.
15.4 The materials contained on this Website are displayed for informational and promotional purposes only. This Website is solely for the private, personal, non-commercial use by its users. You may not download or copy any materials on this Website. No right, title or interest in any material or software is transferred to you as a result of any such downloading or copying. You may not reproduce (except as expressly set forth above), publish, transmit, distribute, display, remove, delete, add to, otherwise modify, create derivative works from, sell or participate in any sale of, this Website, any of the materials on this Website, or any related software. Any other use of materials on this Website, including reproduction for purposes other than those noted above, modification, distribution or republication, without the prior express written permission of Society Service, is strictly prohibited.
15.5 In the event of a violation of this Article by the Client, Article 16 of these Terms and Conditions applies and the Client forfeits an immediately payable fine from Category B.
Article 16. Penalty clause
Upon any breach of the prohibitions and obligations set out in these Terms and Conditions, the Client forfeits, for the benefit of Society Service and without prior notice or notice of default being required, an immediately payable penalty as specified below, without prejudice to Society Service’s right to demand performance and in addition to compensation for greater or additional damage. The penalties are intended as liquidated damages for loss that is difficult to quantify. Each separate breach counts as a separate penalty unit. If a breach continues, a daily penalty is also due at the daily amount applicable to the relevant category, for no more than 30 days per breach, until the breach has demonstrably ended and full cooperation has been provided with remediation. Penalties are not subject to suspension or setoff by the Client and bear statutory interest from the due date. Reasonable out-of-court and court costs are for the account of the Client. The following penalties apply:
- Category A: Penalty of €2.500 per breach and €500 for each day the breach continues.
- Category B: Penalty of €10.000 per breach and €1.000 for each day the breach continues.
- Category C: Penalty of €25.000 per breach and €2.000 for each day the breach continues.
Article 17. Liability and Force Majeure
17.1 To the extent permitted by law, Society Service is not liable for any direct or indirect loss arising from the use of the Website or from the information made available on or via the Website.
17.2 Except in the case of intent or gross negligence, the Escorts and Society Service are liable only for direct and foreseeable loss that is the immediate result of an attributable breach in performing a Booking; liability for indirect loss, including consequential loss, loss of profit, lost savings, reputational harm and non-material damage, is excluded to the extent permitted by law.
17.3 In the event of force majeure on the part of Society Service, meaning a circumstance not attributable to it, obligations are suspended for the duration of the force majeure; Society Service will contact the Client as soon as possible to discuss an appropriate solution and will propose rescheduling or adjustment, and if performance within a reasonable time is not possible Society Service may cancel the Booking without liability with article 11.6 applying; force majeure on the part of Society Service does not entitle the Client to cancel free of charge and article 12 remains fully applicable; to the extent performance has already taken place, the Client owes the proportional part of the Booking Rate and the travelexpenses, External Costs and Surcharges incurred.
17.4 To the extent permitted by law, the total liability of Society Service and the Escort per Booking is limited to the Booking Rate, unless a lower specific maximum is set in these Terms and Conditions such as in article 11.6, and in the case of related events this maximum applies once per Booking.
17.5 Client must notify any event that may give rise to loss without undue delay and take reasonable measures to mitigate loss; the Client will provide verifiable evidence and claims under this article become time-barred, to the extent permitted by law, twelve months after the event from which the loss directly arises.
Article 18. Applicable law and choice of forum
Dutch law exclusively applies to all Assignments, Bookings and these Terms and Conditions. All disputes arising in connection with these Terms and Conditions, Assignments and Bookings that may arise, including disputes about the applicability and validity thereof, shall be settled by the competent court in Rotterdam.
